These Terms of Service (“Terms”) govern your access to and use of 10K Hours (the “Service”), operated by Birkes Innovative Solutions LLC (“we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.
The skills, logs, notes, and other data you enter (“Your Content”) belongs to you. By entering it into the Service, you grant us a limited, non-exclusive license to store, process, and display it to you as needed to operate the Service. We don’t use Your Content for any other purpose.
You are solely responsible for Your Content. Don’t enter anything illegal, infringing, or that violates someone else’s rights. We reserve the right to remove content that violates these Terms or applicable law.
The Service includes an optional AI coaching feature powered by OpenAI. When you use it, we send limited information about your progress (username, skill name, hours, notes from recent sessions) to OpenAI. AI responses are generated, not human-reviewed, and should be treated as suggestions only — not medical, legal, psychological, or professional advice of any kind.
AI feedback is rate-limited to 10 requests per user per 24 hours on the free tier. Paid tiers (if offered in the future) may have higher or no limits.

We reserve the right to suspend or terminate accounts that violate these rules, at our sole discretion, with or without notice.
Parts of the Service are free. We may offer paid tiers in the future. If and when we do, pricing, billing, refund, and cancellation terms will be clearly disclosed at the point of purchase and incorporated into these Terms by reference.
We strive for high availability but don’t guarantee the Service will be uninterrupted, error-free, or available at any specific time. We may change, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. Your data remains yours — if we wind down the Service, we’ll give reasonable notice and an opportunity to export your data.
The Service itself — including its code, design, logos, and name — is owned by Birkes Innovative Solutions LLC. These Terms don’t grant you any rights in the Service beyond the right to use it as described here.
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Your use of the Service is at your own risk.
To the maximum extent permitted by law, Birkes Innovative Solutions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim related to the Service is limited to the amount you’ve paid us in the past 12 months, or $50 USD, whichever is greater.
You agree to defend, indemnify, and hold harmless Birkes Innovative Solutions LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or your use of the Service.
These Terms are governed by the laws of the State of Kansas, United States, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in Kansas, and you consent to their jurisdiction.
We may update these Terms from time to time. Material changes will be announced via email or a notice on the Service. Continued use after the effective date means you accept the updated Terms.
